2019 Prostate Cancer Center 5K

Board to consider an ordinance approving the following requests for the 2019 Chicago Prostate Center 5K to be held on September 8, 2019:

  2. Live amplified sound permit
Background of Subject Matter
The Chicago Prostate Center 5K has been a very successful event for several years. This year's request is the same as the past several years.

Reduction of Class 4 & Class 2 Liquor Licenses
Board to consider an ordinance reducing the number of Class 2 liquor licenses by one (1) due to closure of Saffron Restaurant, 6200 South Cass Ave and reducing the number of Class 4 Liquor License by two (2) due to non-renewal of Woodgrain Neapolitan Pizzeria, 19 W. Ogden Ave and Sweet & Savory Spot, 15 S. Cass Ave.
Background of Subject Matter
Saffron(Class 2) , Sweet and Savory and Woodgrain Pizzeria (both Class 4) did not renew their 2019 liquor licenses. Thus their licenses have been declared forfeit.
Additional Background
The liquor commissioner has declared their licenses forfeited and thus the need to reduce the number of available Class 2 Licenses by one and the number of available Class 4 licenses by Two.

Board to consider an ordinance approving a fence variance at 5832 Raintree Lane.
Background of Subject Matter
Owner requests variance from Ordinance 4.05 (E) (11) to allow construction of a 6-foot fence, where ordinances allow only fences measuring a maximum height of 4 feet.
Additional Background
At its April 10, 2019 meeting, the Planning and Zoning Commission voted 7-0 to recommend approval.

332 59th Street - Garage Variance
Board to consider an ordinance approving variances to allow a detached garage to exceed the maximum allowable square footage and length for detached garages.  
Background of Subject Matter
Owners request a variance from Ordinance 4.05 (E) (15) to allow construction of a garage measuring 816 square feet with a 34-feet length. The current ordinances allow only 576 square feet and 28 feet in length.
Recommendation
Planning and Zoning Commission voted 7-0 to recommend approval on April 10, 2019.

Amendment to allow chairlifts in limited circumstances
Board to consider an ordinance to amend the municipal code and section 1009.4 of the International Building Code (IBC) and International Fire Code (IFC) to allow chairlifts on shared stairwells in condominium common areas.  



Background of Subject Matter
If approved, chairlifts that would reduce the width of a shared stairway would be permitted.
Additional Background
Ms. Augustine lives in a second floor condominium at 1237 Williamsport. She wishes to install a chairlift on the shared stairway. Code prohibits such a chairlift as it would diminish the width of the stairs, raising emergency exiting concerns.
Recommendation
Village Board should weigh request to allow such chairlifts against staff concerns regarding diminished ability to exit a second floor during an emergency.

4 West Burlington - Vape Shop
Board to consider an ordinance approving a B-1 Business District Development Permit for a proposed Vape Shop at 4 West Burlington Avenue. 
Background of Subject Matter
Zoning Ordinance Section 7.02(F)(1) requires any new use or occupancy in the B-1 district to obtain a Development Permit. This proposal is for a Vape Shop at 4 West Burlington.

Increase in Available Liquor License
Board to consider an ordinance increasing the number of available Class 1 Liquor Licenses by one (1) for Clique Sports Bar and Grill, 6010 South Cass Avenue.
Background of Subject Matter
Clique Sport Bar & Grill, 6010 S. Cass Avenue has submitted an application for a Class 1 Liquor License. A background check was conducted which revealed that Clique is eligible to receive this license should the Liquor Commissioner choose to do so.
Additional Background
Restrictions such as no TV or music along with restricted operation times in the outdoor area will be incorporated with the license.

Appointment of Special Counsel
Board to consider an ordinance approving the Mayor's appointment of Ann Marie Lampariello-Perez of Lamp Law, LLC as special legal counsel to prosecute liquor, tobacco, and massage ordinance violations of the Village Code.
Background of Subject Matter
Ms. Lampariello-Perez is now practicing law in a private law firm, however, she has previously prosecuted Westmont liquor, tobacco, & massage ordinance violations. The Village desires to continue this relationship.

Kurtz Paramedic Service - Contract Extension
Board to consider an ordinance approving an extension to the current term of the agreement to provide ambulance service between the Village of Westmont and Kurtz Paramedic Service, Inc.
Background of Subject Matter
Kurtz Paramedic Service, Inc., is requesting an extension to the current term of their agreement with the Village. The term of this extension shall be from May 1, 2019 ("Commencement Date") until April 30, 2020.

Pension Funding Policy
Board to approve an Ordinance amending the Village of Westmont Fire & Police Pension Funding Policy.
Background of Subject Matter
This was initially adopted 4/16/15. It included a provision for assumptions to be updated, and stated current assumptions at that time. We are now amending the official policy with updated assumptions, and clarifying how future adjustments are made.
Additional Background
As an additional note, the interest rate assumption is still under review and may be adjusted again in the near future. However, it is ideal to have an updated policy before the end of the fiscal year.

Intergovernmental Agreement
Board to consider an ordinance approving an Intergovernmental Agreement among the Village of Downers Grove, the Westmont Park District, and the Village of Westmont for drainage improvement projects.
Background of Subject Matter
Downers Grove is proposing to design & construct certain drainage improvements to benefit its residents. Downers Grove seeks the cooperation of the Village & Park District to access Village & Park District properties and/or easements for this work.
Additional Background
Downers Grove is responsible for all costs and work related to this project. The Village will waive permit fees and issue permits for work located on Village properties.

Surplus Property - Public Works Department
Board to consider an ordinance declaring certain Village owned vehicles and equipment as surplus property to be sold at Obenauf Auctions.
Background of Subject Matter
The property identified in the attachment has outlived its useful life, & is outdated, non-functioning, replaced, or otherwise not economically maintainable. Upon being declared surplus & sold, items will be removed from the Village's property inventory.
Additional Background
Five (5) fleet vehicles, two (2) seized vehicles, two (2) trailers, and seventeen (17) pieces of equipment will be disposed of by auction through Obenauf Auction Services, Inc. on behalf of DMMC.
Recommendation
Staff recommends approval of this declaration of listed vehicles and equipment as surplus and the method of disposition.
