Reduction in Available Liquor Licenses
Board to consider an ordinance reducing the number of available liquor licenses due to the forfeiture of liquor licenses by various businesses. 
Background of Subject Matter
Several businesses did not renew their 2020 liquor license. Liquor commission has declared these licenses forfeited, requiring a reduction. Woodgrain (Class 4), Bakersfield (Class 2 & 16), Yu's Mandarin (Class 2), & Truffleberry Market (Class 18).
Additional Background
All have either been closed or ceased sales & service of alcohol for more than 30 consecutive days, thus causing their liquor licenses to be declared forfeit/lapsed.

Lease for Space in Westmont Centre
Board to consider an ordinance approving a Westmont Centre lease for Maercker District 60. 
Background of Subject Matter
Maercker District 60 is interested in leasing additional space at Westmont Centre for storage needs.

Nicor Antenna Site License Agreement
Board to consider an ordinance approving a Personal Communications System Site License Agreement with Nicor Gas Company.
Background of Subject Matter
Nicor desires to install an antenna facility on the water tower located at 328 S Wilmette, along with related equipment. A Site License Agreement is required. This antenna & equipment will occupy less space than a typical cellular communications antenna.
Additional Background
The initial term is 5 years, with 4 renewal options of 5 years each. Nicor will pay an annual license fee to the Village. If approved, this remains subject to building, engineering and zoning review.

Intergovernmental Agreement - DuPage County
Board to consider an ordinance approving an Intergovernmental Agreement with DuPage County for maintenance of Liberty Park stormwater and drainage improvements.
Background of Subject Matter
The Village owns various stormwater, flood control & drainage properties in the Liberty Park neighborhood, including pump stations & detention basins. Under this IGA, the County will inspect & maintain those facilities & charge the Village services.
Additional Background
This IGA formalizes the current practice of the parties regarding these facilities. The County is uniquely qualified to maintain the lift stations, etc.

Text Amendment for Massage Therapy Establishments
Board to consider an ordinance approving Zoning Ordinance text amendments to create zoning definitions and regulations for ‘massage therapy establishments’, ‘medical or dental clinics’, and ‘health club and fitness center’.
Background of Subject Matter
The Village currently regulates massage therapy establishments through Business Licensing Chapter 22, Article XVII. The Zoning Ordinance is silent on regulations related to the location of these establishments in business and commercial districts.
Additional Background
The Community Development Department has reviewed these provisions in the Village Code with other Village staff in an effort to provide for regulations governing the location of these establishments, while ensuring compliance with current State law.
Recommendation
The Planning and Zoning Commission recommended approval.
