Small Cell Antenna/Tower Right-of-Way Siting Ordinance
Board to consider approving an amendment to Chapter 82 of the Wesmont Code of Ordinances regarding siting of small cell antennas/towers in public rights-of-way.
Background of Subject Matter
There is a growing trend nationwide for the personal wireless telecommunications industry to install small cell facilities on existing utility and street poles in the public ROW. The Village does not specifically regulate this new technology currently.
Additional Background
This ordinance was based on a model ordinance prepared and recommended by IML. It provides the Village with certain controls over the siting of these small cell facilities.

Fire & Police Commissioner Reappointment
Board to approve a motion reappointing Mr. Robert Kovanda as a commissioner and the chairman of the Board of Fire and Police Commissioners.
Background of Subject Matter
Mr Kovanda has been a member of the Board of Fire & Police Commissioners since February 7, 2000.

409 N Grant Street - Setback Variance
Board to consider an ordinance requesting a Zoning Code variance request to allow for construction of a new home within the required front yard setback to mitigate an existing Heritage Tree in the R-3 Single Family Detached Residence District.
Background of Subject Matter
P&Z discussed aspects of the heritage tree classification, protection methods, & overall effect a decreased front yard setback to the surrounding properties. Applicant was commended for his willingness to work with staff despite time & additional costs.
Additional Background
Commission made a positive recommendation by 6-1, affirming both applicant & staff consensus that the setback variance was nominal to the neighborhood & justified for the heritage tree considerations.
Recommendation
The staff recommends approval to support this significant heritage tree and requests a waiver of the variance application fees by the Board to minimize the financial impact to the applicant.

Burr Oak Drive Water Main improvements
Board to consider an ordinance authorizing an engineering service agreement with Baxter and Woodman for Phase 1&2 design engineering services for the Burr Oak Water main replacement project.
Background of Subject Matter
The project includes approximately 1,200 linear feet of 8" P.V.C. pipe to replace the old cast iron pipe. The water main will be replaced on Burr Oak from Chestnut to Plaza. Construction will not start until late July.
Additional Background
Request to approve the sum of $32,500 for Ph1&2 engineering services.

Nicor Franchise Agreement
Board to consider an ordinance approving a franchise agreement with Nicor to construct, operate and maintain a gas distribution system in the Village.
Background of Subject Matter
The current franchise agreement with Nicor has expired & a new agreement is required. Nicor must comply with Village right-of-way regulations, must repair any damage caused by its work & agrees to indemnify the Village for claims arising out of such work.
Additional Background
The term of this new agreement is 30 years. A separate letter agreement from Nicor will provide the Village with free therms of natural gas to Village-owned buildings during the term of the franchise agreement.

Elevator Standards Ordinance
Board to consider an ordinance amending Chapter 18, Article XIII of the Village Code of Ordinances regarding elevator standards, inspections and fees.
Background of Subject Matter
The IL State Fire Marshall currently prescribes standards, issues permits & performs inspections of elevators within the Village. The Village wishes to take over these tasks, & wishes to utilize the services of a 3rd party elevator inspection company.
Additional Background
This proposed ordinance establishes the standards and procedures for elevator construction, maintenance and repair, and also establishes the permit fees for such matters. Third party inspection fees are reimbursable from the owner.
